Practicing exclusively federal law is possible, but it comes with certain restrictions and considerations. In Texas, for example, if you are admitted to practice in a U.S. District Court, you can practice exclusively federal law without infringing on areas of Texas state law.
However, you would not be allowed to give legal advice pertaining to matters relating to Texas law unless it is within the parameters of a legal proceeding in federal court.
Potential practice areas suitable for a small law office focusing exclusively on federal law include immigration, bankruptcy, admiralty law, federal copyright and patent litigation, federal criminal law, federal civil rights, and federal employment litigation under the Americans with Disabilities Act.
It is important to note that each state has its own rules regarding the unauthorized practice of law (UPL). For instance, in the District of Columbia, Rule 49 distinguishes between attorneys who represent only clients in federal court and those who also represent clients in state court or draft documents for state clients.
An attorney with an office in D.C., who is a member of the bar of Maryland or Virginia (but not D.C.), and whose practice consists exclusively of representing residents of those states in the courts of those states or concerning transactions in those states, is practicing law in the District of Columbia and violating Rule 49(a).
Some states have issued ethics opinions regarding whether it would be ethical for an attorney living in their state who is licensed in another state to practice federal law exclusively. For example, Virginia Legal Ethics Opinion 1896 (January 2022) states that a lawyer who is not licensed in Virginia may work from a location in Virginia on a continuous and systematic basis, as long as that practice is limited to exclusively federal law and/or the law of the lawyer’s licensing jurisdiction.
